A jakim prawem rada uchwala budżet w pełnej szczegółowości (dział, rozdział, paragraf)?- patrz art. 184 ust. 1, pkt 2 ufp.
Napisałam, że bez upoważnienia Rady wójt.... nie może dokonywać zmian.
Bez upoważnienia rady może tylko w zakresie określonym w art. 188 ust. 1.

Przy takim założeniu to wszystko co uchwali rada nie podlega zmianie przez zarząd, wszystko jest zapisane w załącznikach do uchwały rady i dochodzimy do absurdu. Jeśli budzet jest uchwalony w pełnej szczegółowości to co wtedy? |

Zgodnie z art. 184 ust. 2 pkt 2 ustawy, uchwała budżetowa jednostki samorządu terytorialnego może zawierać upoważnienie dla zarządu jednostki samorządu terytorialnego do dokonywania zmian w budżecie, w zakresie określonym w art. 188 ust. 2.
Moim zdaniem, jeżeli rada nie zastrzegła zmian z wydatków bieżących na majątkowe w ramach tego samego działu, takie zmiany może dokonywać organ wykonawczy. |

| Rio zapewne zauważyło cytowane zmiany. Ale dokona zastrzeżeń wtedy, gdy zauważy niezgodność w WPI np przy jakiejś uchwale, albo przy sprawozdaniu rocznym. Ja ten temat przerabiałam i robię to tak: jeśli w obrębie jednego działu dokonywane są przesunięcia (w tym w zadaniu w WPI) to załącznikiem do Zarządzenia jest tylko roczny plan wydatków majątkowych. Na najbliższej sesji dokonuje zmian w WPI żeby te zmiany wcześniejsze uwzględnić. I wsio. |
