Mamy wpłacone zabezpieczenie należytego wykonania umowy od firmy, która już nie istnieje. Następcy prawnego nie ma. Na depozyt sądowy nie opłaca się dawać (bo trzeba za niego płacić a i tak nic się nie wyjaśni). Co mamy zrobić z tymi pieniędzmi, trzymać do końca świata na wyodrębnionym koncie- na lokacie (tak mamy zabezpieczenia) czy też możemy sobie te pieniądze przekazać na dochody?

Najpierw lepiej sprawdzić, czy rzeczywiście już nie istnieje, tzn. czy została wykreślona z rejestru sądowego/ ewidencji działalności gospodarczej. Jeżeli faktycznie firma już została wykreślona z rejestru, a nie ma następcy prawnego, to osobiście potrzymałabym jeszcze te pieniądze na lokacie; dopiero po upływie okresu przedawnienia roszczeń (z kodeksu cywilnego - chyba 3 lata, dokładnie trzeba sprawdzić) przyjęłabym na dochody.
